This presentation will be in the form of a roundtable discussing the ever-changing laws and culture surrounding non-competes and non-solicitations. As healthcare professionals are aware, these agreements are very common and, in many instances, a requirement to protect business interests, especially when it comes to employee retention and protecting the goodwill of a business during a purchase. However, in the last year, many state and federal proposals have been introduced to restrict or eliminate and void these types of agreements.
Just this past year, the Federal Trade Commission (FTC) announced that the FTC is proposing a new regulation that would restrict non-competes nationwide. It is expected to pursue President Biden’s campaign promise with these regulations this year. This comes on the heels of states implementing similar, and binding, restrictions, such as in California, Colorado, Illinois, Maryland, Oregon, Virginia, and Washington, among many others.
